WHAT IS PROBATE?

If a person passes away leaving a valid Will, the executor named in that Will may need to apply for a Grant of Probate through the Supreme Court of NSW.

This grant gives the executor the legal authority to manage the estate — including collecting assets, paying debts, and distributing property according to the Will.

Letters of Administration

When a person passes away without a valid Will, they are said to have died intestate. In this case, someone (usually a close family member) must apply for Letters of Administration to be legally appointed as the estate’s administrator.

The process can be more complex than Probate, as the law determines who inherits the estate and in what proportions — rather than the person’s wishes.
