Resolving estate disputes with fairness, understanding, and respect.

When someone passes away, emotions often run high — and sometimes disagreements arise over how their estate should be managed or distributed.
At Allan Hogan Solicitor, we understand that these matters are sensitive and deeply personal.

We provide clear, compassionate, and practical legal advice to help families resolve disputes respectfully and reach fair outcomes, without unnecessary stress or conflict.

WHAT IS AN ESTATE DISPUTE?

An estate dispute can occur for many reasons — perhaps someone feels they were unfairly left out of a Will, the validity of the Will is in question, or there are concerns about how an executor is managing the estate.

Common disputes include:

  • Questions over the validity of a Will

  • Claims for further provision from an estate

  • Disagreements between executors or beneficiaries

  • Delays or mismanagement in estate administration

We’ll listen carefully to your concerns, explain your rights, and outline the best options to resolve the issue — whether through negotiation, mediation, or, if necessary, court proceedings.

What is a Family Provision Claim

Under the Succession Act 2006 (NSW), certain people (such as spouses, children, and dependants) may be able to make a Family Provision Claim if they believe they have not been adequately provided for in a Will or under intestacy.

If you believe you’ve been unfairly left out, or you’re an executor defending such a claim, we can help. Our role is to ensure the process is handled fairly, efficiently, and with minimal disruption.

We’ll:

  • Assess whether a claim is likely to succeed

  • Prepare and lodge all necessary documents

  • Represent you in negotiations or mediation

  • Aim to resolve the matter quickly and cost-effectively

Our focus is always on achieving a fair result with respect and discretion.

Contesting or defending a Will

Disputing a Will can be complex and emotionally challenging. Whether you’re contesting a Will or defending one, we provide balanced, realistic advice to help you make informed decisions.

We’ll guide you through:

  • Eligibility and time limits for contesting a Will

  • Evidence and documentation required to support your case

  • Negotiation and mediation options to avoid court

  • Court representation, if necessary

Our approach is always practical and people-centred — we’ll help you navigate the legal system with sensitivity and integrity.

Our approach

Every family situation is unique, and every estate matter deserves care and understanding.
We take the time to listen to your story, explain the process in plain English, and work towards a resolution that balances both fairness and family relationships wherever possible.

We aim to:

  • Reduce stress and confusion

  • Avoid unnecessary litigation where possible

  • Provide honest advice about your prospects and options

  • Protect your legal and financial interests at every stage
